The terms apply to all agreements regarding sale and delivery of my services to business customers – including photography and image processing services.
Together with my quote and personal data policy, the terms of service form the overall basis of the agreement.
3.1. Bookings can take place via the website quotation form or contact form, or via email, phone or social media. 3.2. A quote is valid for 7 days unless stated otherwise 3.3. An order is confirmed when you have accepted the quote and the included terms of service.
4.1. Since every photography assignment is unique, I custom quote each project. 4.2. In most cases I will give a quote with a fixed price for the total order. Depending on the nature of the assignment, I can also give a quote based on a daily/hourly rate, or a price per image. 4.3. If you want to make amendments or changes after you have accepted the quote, this may result in extra work or overtime that is not included in the quote. You will be informed of any additional charges before the work is carried out. 4.4. The price in a quote assumes that the work can be carried out as a single delivery (unless specifically agreed otherwise). 4.5. All prices are in DKK and exclusive of VAT, unless specifically stated otherwise. 4.6. International clients have to be VAT registered businesses, and reverse VAT charge will apply. 4.7. If you would like the products to be returned after the photo shoot, you should state this in connection with your booking. Any shipping costs incurred by me, will be added to the total invoice.
5.1. Payment is made via bank transfer, no later than the date stated on the invoice. The payment deadline is 15 days from the invoice date (unless otherwise agreed). 5.2. In case of late payment, I am entitled to 5% interest on the overdue amount per month started from the due date and until payment is made. 5.3. Expenses related to specially sourced props or outside services (models, assistants, rentals, etc.) will be charged at the amount invoiced to me, or they can be invoiced directly to you. If they are invoiced to me, I may require an advance payment corresponding to the total amount of the expenses. 5.4. For large projects I may require an advance payment of 50%.
6.1. If you have already accepted an offer, and you wish to cancel your order less than 14 days before the shoot, you will be charged 50% of the order amount, unless it is possible to reschedule the shoot within 30 days. For cancellations more than 14 days before the shoot, the charge is 25%. 6.2. In case of cancellation on your part, you will also be liable for any expenses for specially procured props or outside services that have already been held with the purpose of carrying out the task. 6.3. There is no right to withdrawal or cancellation once your order has been put into production. From this point on, the full order amount will be invoiced. 6.4. If I need to cancel, any advance payment (see point 5.3. and 5.4.) will be refunded unless it is possible to reschedule the shoot within 30 days.
7.1. The images are delivered digitally and can be downloaded via a Wetransfer or Dropbox link which will be sent to you by email. 7.2. I store the images for 90 days and they are also available for download throughout this period. I am not responsible for storing your images after 90 days, unless otherwise agreed. 7.3. I deliver the images in edited form. We usually agree as part of the offer how much post production and retouching is to be carried out, based on your goals with the images and their intended use. Additional post production work can also be added to your order at a later stage. 7.4. We agree in which formats the images are to be delivered, depending on what the images are to be used for (this will be stated in your quote or shot plan). I do not deliver images in RAW format. 7.5. Depending on the type of shoot, I may send you a link to a selection
gallery before I start the post production work. I may do a rough sorting before I send you the link. 7.6. The estimated delivery time is stated in the quote or order confirmation. I will go to great lengths to deliver within the agreed time, but if I expect a delay, I will inform you of this immediately, together with the reason and new expected delivery time. 7.7. You have the right to cancel your order in relation to delays on my part. No other claims can be made against me in connection with delays.
8.1. Complaints must be presented within a reasonable time in order to be legally valid. 8.2. In the event of deficiencies or errors committed on my part, I have the right, but not an obligation, to remedy the deficiencies within a reasonable time (5 working days) and without extra charge. 8.3. If I cannot remedy the defects within a reasonable time, then you have the right to cancel the order to which the defect relates, or receive a reasonable reduction in the price for the order in question. Please note that you will not have any usage rights for the images if you choose to cancel the order. 8.4. Errors and defects which are due to insufficient instructions on your part, do not give the right to cancellation or rectification without extra charge. 8.5. Once you put the images into use, they are automatically considered fully approved, meaning that the right to complain no longer applies.
9.1. As a photographer, I retain the copyright to the images. The images may not be resold or copied. 9.2. As the copyright owner I can use the images for marketing purposes, but if you do not want them to be published I will respect this. If that is the case, please bring it to my attention in connection with entering into an agreement. 9.3. As a customer, you have full usage rights for the delivered images. The images may also be shared with third parties, as long as the purpose is marketing of your own company. 9.4. The images in a selection gallery may not be copied, downloaded, photographed (including screenshots), shared or printed. The images may only be used for review and selection purposes.
10.1. My liability can never exceed the amount of the order to which the claim relates. 10.2. I cannot be held responsible for indirect losses, including loss of sales, profit, time, goodwill or losses as a result of my customers’ legal relationships with third parties (except in cases of intentional or grossly negligent behaviour). 10.3. I cannot be held responsible for failure to fulfill obligations due to force majeure (circumstances beyond my control). It could, for example, be unusual natural conditions, war, terror, fire, flood, epidemic/pandemic and vandalism. 10.4. I cannot be held responsible for losses or delays caused by errors or damage to production equipment.
In order for us to enter into an agreement, I will need some details, including your VAT number, name, address, telephone number and email. I collect the information with the aim of being able to process your inquiries and deliver my services. Data processing takes place in accordance with my privacy policy.
All agreements and collaborations are subject to Danish law. Any dispute that may arise must be settled by a Danish court
